1. Acceptance of Terms

By accessing or using Endless Worlds ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Dawnforge LLC ("we," "us," or "our"), the operator of Endless Worlds.

2. Description of Service

Endless Worlds is a platform for worldbuilding, story organization, and creative writing tools. We provide:

• Tools to create and organize characters, worlds, mythologies, and story elements
• Optional AI-assisted content generation features
• Storage and management of your creative content
• Export capabilities for your work
• Collaboration and organization features

3. Account Requirements

3.1 Eligibility: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have parental consent.

3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3 Accurate Information: You agree to provide accurate, current information and keep it updated.

4. Intellectual Property and Content Ownership

4.1 Your Content

You own your creative content. All stories, characters, worlds, and other creative works you create using the Service remain your property. We claim no ownership rights to your content.

4.2 License to Us

By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, and display your content solely to provide and improve the Service. This license ends when you delete your content or account.

4.3 AI-Assisted Content

Content generated with AI assistance through our platform is yours to use. However:

• Copyright protections for AI-generated content may be limited or unclear under current law
• We make no representations about the copyrightability of AI-generated content
• You are responsible for ensuring your use complies with applicable laws
• By providing rich, original context (characters, worlds, plots), you strengthen your claim to the final work
• AI generation features are subject to availability and may have usage limits

4.4 Our Platform

The Service itself, including its design, features, code, and trademarks, is our property and protected by copyright and other laws.

5. Pricing and Payment

5.1 Subscription Plans

We offer various subscription tiers with different features and credit allocations. Pricing is displayed on our website.

5.2 Credits

Some features consume credits. Credits may be included in your subscription or purchased separately. Credits are non-refundable and non-transferable.

5.3 Billing

Subscriptions are billed in advance on a recurring basis through Stripe. You authorize us to charge your payment method. Prices may change with 30 days notice.

5.4 Cancellation and Refunds

You may cancel your subscription anytime through your account settings or by contacting support. Stripe handles all subscription management, including cancellations and proration. When you cancel:

• You retain access to paid features through the end of your current billing period
• No further charges will be made after the current period ends
• All credits you've earned or purchased remain in your account and do not expire
• You can continue to use your credits even after your subscription ends

Refunds are handled according to Stripe's policies and applicable law. We generally do not provide refunds for partial periods, except as required by law or at our discretion.

6. Acceptable Use

You agree NOT to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Upload malicious code or attempt to compromise security
• Abuse, harass, or harm others
• Create content depicting illegal activities, child exploitation, or non-consensual acts
• Resell or redistribute the Service without permission
• Scrape or data mine the Service
• Attempt to reverse engineer the platform
• Use the Service for spam or unauthorized marketing

We reserve the right to suspend or terminate accounts that violate these terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or quality of AI-generated content
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding security or data loss prevention

You use the Service at your own risk. We recommend backing up important work.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAWNFORGE LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or content
• Damages resulting from third-party AI services
• Service interruptions or security breaches

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

• Your use of the Service
• Your content
• Your violation of these Terms
• Your violation of others' rights

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• You may export your content within 30 days
• We may delete your data after 30 days
• No refunds will be provided for unused subscription time (except as required by law)

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes via email or the Service. Continued use after changes constitutes acceptance.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Arkansas. Any disputes shall be resolved through binding arbitration, except for claims that may be brought in small claims court.

You waive any right to a jury trial or to participate in class action lawsuits.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
